Welcome to Maitre D’ Delivery.
This page tells you the terms that apply when you order food products (“Food”) from Maitre D’ Delivery Ltd (“we”, “our” or “Maitre D’”) using the maitred-delivery.com website (“our Website”). Please read these terms carefully before using our Website. By ordering Food through our Website, whether now or in the future, you agree to be bound by these terms. Use of our Website is also subject to these terms. We reserve the right to change these terms from time to time by changing them on this page. We advise you to print a copy of these terms for future reference.

Maitre D’ Delivery Ltd is incorporated and registered in Northern Ireland. Our Company registration number is NI674551. You may contact us at firstname.lastname@example.org.
Our objective is to link you to the businesses we partner with (“Partners"). Where you order Food from a Partner (“Food Partner”), Maitre D’ acts as an agent on behalf of that Food Partner to conclude your order from our Website, to manage your experience throughout the order process and to arrange delivery of your Food. Where you order alcohol products (“Drinks”) from our licensed Partner (“Drinks Partner”), you do this directly with our Drinks Partner and Maitre D’ acts only as a delivery agent on behalf of our Drinks Partner to deliver your Drinks. The ordering of Food and delivery of Food with or without Drinks constitutes Maitre D’s customer proposition (our “Service”).
You can open a Maitre D’ account to make the ordering process easier. When you open an account you will create a password and can also store credit card details when you make an order. You must keep the password you create secret, and prevent others from accessing your email account or mobile phone. If another person uses these methods to access your account, you will be responsible to pay for any Food they order, and we are not responsible for any other losses you suffer, unless the person using your password obtained it because we did not keep it secure.
You may close your account at any time by contacting us via our Website and requesting us to do so. We may suspend your access to your account, or close it permanently, if we believe that your account has been used by someone else. We may also close your account if in our opinion you are abusing our Service (for example, by applying for refunds or credit to which we do not consider you are entitled, making repeated unreasonable complaints, mistreating our staff or Drivers, or any other good reason).
Maitre D’ has a prescribed delivery area that is limited to the following postcodes: BT1- BT21, BT23, BT24, BT26, BT27, BT28, BT29, BT36, BT37, BT38, BT39, BT40, BT41, BT42, BT43, BT45, BT62, BT63, BT64, BT65, BT66, BT67, BT71 & BT80. This delivery area may change at any time due to factors such as weather, or demand on our service. Our Partners each decide their own operating hours. That means that the availability of our Service, and the range of Partners from which you can order, depends on the Partners. If you try to order a delivery to a location outside our prescribed delivery area or operating hours of a Partner, or our Website is otherwise unavailable for any reason, we will notify you that ordering will not be possible.
When you place an order for Food through our Website, it needs to be accepted by us before it is confirmed. We will send you a notification if your order has been accepted (the "Confirmation Notice"). The contract for the supply of any Food you have ordered comes into existence when we send the Confirmation Notice. You are responsible for paying for all Food ordered, and for related delivery charges, and for complying with these terms, even if you have ordered the Food for someone else. All Food is subject to availability.
Food Partners may use nuts or other allergens in the preparation of certain Food and we will display on our Website the allergen information provided by our Food Partners. Where that information is not available or if you have further questions, please contact the Food Partner prior to ordering if you have an allergy or intolerance. Maitre D’ cannot guarantee that any of the Food sold by our Food Partners is free of allergens.
When you place an order for Drinks with our Drinks Partner, you are subject to their terms and conditions and the contract for supply is with them. To take advantage of Maitre D’s Service you must select the Maitre D' free delivery option when ordering from our Drinks Partner and advise them of the order number from your Food order. We cannot guarantee that recommended wines will be available from our Drinks Partner as this depends on their stock levels and demand.
When you place an order for Food, you will choose a delivery date. Where you order Drinks from our Drinks Partner to accompany your Food, Maitre D’ will deliver your Food and Drinks together. The delivery of Food with or without Drinks will be made by a delivery driver (“Driver”) between 12pm and 7pm on the chosen delivery date and you must be available to accept the delivery.
Unfortunately, despite our, and our Partners’ best efforts, things do not always go to plan and factors such as traffic and weather conditions may prevent us from making your delivery during this time window. In this case we will work with you to make things right unless you have caused the delay (e.g. because you gave us the wrong address or did not come to the door).
We will attempt delivery at the address you provide to us when you place your order. If you need to change the delivery location after you have placed your order, we may be able to change the address to an alternative one if you let us know prior to the delivery date, and the new address is within our prescribed delivery area. If we cannot change the delivery address, you have the option to cancel the order, but if food preparation has started you will be charged the full price for the Food.
You will still be charged for Food and Drinks and for delivery in the event of a failed delivery if you have caused such failure for any reason. Reasons you might cause a delivery to fail include (but are not limited to):
You do not come to the door, did not pick up the phone when the Driver contacted you using the contact information you have provided us and/or you picked up the phone but then failed to provide access within a reasonable amount of time, and the Driver is unable to find a safe location to leave the Food and Drinks.
The Driver refuses to deliver Drinks to you in accordance with the section on Age Restriction.
Our priority at Maitre D’ is to offer the safest possible service to our customers, Partners and Drivers and we have set out a number of important steps to ensure we deliver orders safely for everyone. For example, we will be utilising contact-free delivery for all our deliveries, our Drivers will be wearing face coverings and gloves and adhering to the guidelines regarding safe distancing (2m).
Our Drivers will place the order outside the customer’s door, step a safe distance back, alert the customer as to the arrival of the order and wait nearby for the customer to collect the food. If the customer is not at home the order will be placed in a safe place.
As per the European Food Safety Authority there is “no evidence that food is a likely source or route of transmission of the virus”. We do however understand this is a difficult and worrying time for each one of us, and we at Maitre D’ want to assure you that safety is our priority throughout this unprecedented time and beyond it.
You have a legal right to receive goods which comply with their description, which are of satisfactory quality and which comply with any specific requirements you tell us about (and we agree to) before you place your order. If you believe that the Food you have been delivered does not comply with these legal rights, please let us know. We may request a photograph showing the problem if it is something that can be seen by inspecting the Food. We will provide a refund in respect of the affected part of the Food, and also in respect of delivery if the whole order was affected, unless we have reasonable cause to believe that the problem was caused after delivery.
Prior to processing your refund, we may take into account relevant factors including the details of the order, your order history, what happened on delivery and information from the Driver.
Alcohol can only be sold and delivered to persons aged 18 or over. Where you purchase Drinks from our Drinks Partner you are subject to their terms and conditions. Where Maitre D’ acts as a delivery agent on behalf of our Drinks Partner to deliver your Drinks, we operate an age verification policy whereby you will be asked by the Driver to provide proof that you are aged 18 or over before the delivery is completed. The Driver may refuse to deliver any Drinks to any person unless they can provide valid photo ID proving that they are aged 18 or over. The Driver may refuse to deliver alcohol to any person who is, or appears to be under the influence of either alcohol or drugs. If delivery of any Drinks is refused, you will still be charged for the relevant Drinks and for delivery.
You may cancel a Food order without charge provided this is done by 3pm on the day before delivery and our Food Partner has not yet started preparing the Food. If you wish to cancel an order please contact us immediately, via our Website. If the Food Partner confirms that preparation has not started, we will refund your payment (excluding any payment gateway fees). If you cancel a Food order after the Food Partner has started preparing the Food, you will be charged the full price for the Food, but we will refund the delivery charge.
Maitre D’ and the Food Partner may notify you that an order has been cancelled at any time. You will not be charged for any orders cancelled by us or the Food Partner, and we will reimburse you for any payment already made.
You confirm that you are using our Service for personal, non-commercial use. Maitre D’ may operate dynamic pricing some of the time, which means that prices of Food and delivery may change while you are browsing. Prices can also change at any time at the discretion of the Food Partner. We reserve the right to charge a Service Fee, which may be subject to change, for the provision of our Services. You will be notified of any applicable Service Fee and taxes prior to purchase on the checkout page on our Website. No changes will affect existing confirmed orders, unless there is an obvious pricing mistake. Nor will changes to prices affect any orders in process and appearing within your basket, provided you complete the order within 2 hours of creating the basket. If you do not conclude the order before the 2 hour cut-off the items will be removed from your basket automatically and the price change will apply. If there is an obvious pricing mistake, we will notify you as soon as we can and you will have the choice of confirming the order at the original price or cancelling the order without charge and with a full refund of any money already paid. Maitre D’ will charge you a delivery fee. This will be notified to you during the order process before you complete your order.
The total price of your order will be set out on the checkout page on our Website, including the prices of Food, delivery and applicable Service Fees and taxes.
Payment for Food and delivery can be made on our Website by credit or debit card, or other payment method made available by Maitre D’ such as Gift Vouchers. Once your order has been confirmed your credit or debit card will be authorised and the total amount marked for payment. Payment is made directly to Maitre D’ acting as agent on behalf of the Food Partner. We are authorised by our Food Partners to accept payment on their behalf and payment of the price of any Food or delivery charges to us will fulfil your obligation to pay the price to the Food Partner.
Food Partners sometimes make special offers available through our Website. These are visible when you look at a Food Partner menu. These offers are at the discretion of the Food Partner. Unless the offer terms state a fixed or minimum period for which an offer will be available, it can be withdrawn at any time, unless you have already placed an order based on the offer and we have sent the Confirmation Notice.
Gift Vouchers can be purchased via our website. Your Gift Voucher will be sent to you by email and contain a unique promo code that is subject to a time limit. The expiry date for your Gift Voucher will be stated on the email in which it is sent to you. You will be unable to use a Gift Voucher not redeemed before this expiry date.
To redeem your Gift Voucher, enter the unique promo code on the Gift Voucher at the checkout to pay for Food. Only one Gift Voucher can be redeemed per order. Gift Vouchers can only be used once. Gift Vouchers cannot be used to pay for delivery. If your Food purchase exceeds the value of your Gift Voucher, the rest of your order must be paid with another payment method. If your Food purchase is less than the value of your Gift Voucher the balance of your Gift Voucher will be lost.
If you pay for Food in whole or in part using a Gift Voucher and your order is cancelled or you are entitled to a refund, your Gift Voucher will be re-issued to you. There will be no monetary exchange for cancelled orders made with Gift Vouchers.
Please look after your Gift Voucher. Maitre D' is not responsible if a Gift Voucher is lost, stolen, damaged, destroyed or used without your permission and if this happens your Gift Voucher will not be replaced.

We have taken every care in the preparation of our Website and our Service. However, we will not be responsible for any errors or omissions in relation to such content or for any technical problems you may experience with our Website or our Service. If we are informed of any inaccuracies on our Website or in our Service we will attempt to correct this as soon as we reasonably can. To the extent permitted by law, we exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our Website, our Service, and any website linked to our Website and any materials posted on it. This does not affect our liability for death or personal injury arising from our negligence, or our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.

Jurisdiction And Applicable Law
We collect your personal information when you interact with us or use our services. We also look at how visitors use our Website, to help us improve our services and optimise customer experience.
We collect information:
when you create an account with us or you change your account settings;
when you place an order with us and during the order process (including for payment and order delivery);
when you contact us directly via email or post; and
when you browse and use our Website.
When you visit our Website or make a Maitre D’ order through our Website, you are asked to provide information about yourself including your name, contact details, delivery address, order details and payment information such as credit or debit card information.
We also collect information about your usage of our Website and information about you when you contact us or provide us with feedback.
We also collect technical information about your use of our Website through your mobile device or computer.
We will only process the data we collect about you if there is a reason for doing so, and if that reason is permitted under data protection law.
Where we need to in order to provide you with the service you have requested or to enter into a contract, we use your information:
to supply the services you have requested;
to enable us to collect payment from you; and
to contact you where necessary concerning our Service, such as to resolve issues you may have with your order.
We also process your data where we have a legitimate interest for doing so. We have listed these reasons below:
to improve the effectiveness and quality of service that our customers can expect from us in the future;
to contact you for your views and feedback on our Service or our Partners’ products and to notify you if there are any important changes or developments to the Website or our Service, including letting you know that our Service is operating in a new area, where you have asked us to do so;
to send you information by post about our Service and promotions (if you do not want to receive these, you can let us know by getting in touch;
to analyse your activity on the Website so that we can administer, support, improve and develop our business and for statistical and analytical purposes and to help us to prevent fraud;
We also process your data to enforce our contractual terms with you and any other agreement, and for the exercise or defence of legal claims and to protect the rights of Maitre D’, Food Partners, Drivers, or others (including to prevent fraud).
If you submit comments and feedback regarding the Website and the Service, we may use such comments and feedback on the Websites and in any marketing or advertising materials. We will only identify you for this purpose by your first name and the city in which you live.
Where we are under a legal obligation to do so we may use your information to create a record of your order(s) and comply with any legal obligation or regulatory requirement to which we are subject.
